•Dlouhodobě známý problém – degradace půd: • erozní ohrožení půd • vodní eroze - maximální ztráta půdy v ČR vyčíslena na přibližně 21 mil. tun ornice za rok, což lze vyjádřit jako ztrátu minimálně 4,3 mld. Kč. Škody vodní erozí vyčíslené na základě odhadu nákladů na odstranění sedimentů a ztráty živin dosahují odhadem ročně více než 10 mld. Kč • větrná eroze – silně ohroženo 4 %, celkově 20% • úbytek organické hmoty v půdě; • utužení půd…………… •Jedna z možností řešení problému – dodávání organické hmoty do půdy (statková hnojiva, organická hnojiva,-meziplodiny….)
Situace v zemědělství v ČR před vstupem do EU: -vysoká produkce statkových hnojiv – 700 tis.tun čistých živin- 310 tis.tun K, 260 tis.tun N, 130 tis.tun P; -vysoká produkce organických hnojiv – 4 mil.tun; - dotační titul v roce 2000 „Finanční podpora pro užití kompostů“ v rámci nařízení vlády č. 344/99 Sb., kterým se stanoví podpůrné programy k podpoře mimoprodukčních funkcí zemědělství, k podpoře aktivit podílejících se na udržování krajiny a programy pomoci k podpoře méně příznivých oblastí.Kritériem pro poskytnutí podpory bylo předložení daňového dokladu o nákupu registrovaného kompostu (dle zák. č. 156/1998 Sb., o hnojivech) nebo daňového dokladu o provedení aplikace na objednávku. Výrobci kompostů museli být podle platného zákona registrováni. Státní podpora při hnojení průmyslovými komposty se projevila zájmem o registrované komposty jichž byl nedostatek a řada kompostáren obnovila činnost.Tím byl nastolen trend rozvoje kompostáren v ČR a nárůst výroby kompostů. Tento dotační titul byl v roce 2001 zrušen pro neprůhledné a chybné zúřadování (falečné faktury apod.).

Situace v zemědělství v ČR po vstupu do EU:
- Redukce zdrojů organické hmoty v ČR - nízká produkce statkových hnojiv v důsledku snížení stavů hospodářských zvířat; - nízká produkce organických hnojiv cca 500 tis.tun za rok. - žádné dotace pro výrobu a používání organických hnojiv - v rámci Operačních programů Zemědělství a Ministerstva životního prostředí podporována výstavba a rekonstrukce kompostáren - výstavba kompostáren podpořena z OPŽP, prioritní osa 4 (Dotace pro odpadové hospodářství a odstraňování starých ekologických zátěží), oblast podpory 4.1. Zkvalitnění nakládání s odpady). - Program rozvoje venkova MZe na období 2007–2013 Osa I.1.1 Modernizace zemědělských podniků-peletovací linky a kotelny na biomasu.

Problémem - Potřeba kompostů v zemědělství je o 100% vyšší než stávající produkce - jdou všechny vyprodukované komposty na zemědělskou půdu??? Argument proč nelze zemědělcům uložit povinnost používat komposty – nerovnoměrné rozmístění kompostáren v ČR – v některých oblastech chybí.

Základní problémy a úkoly při ochraně ZPF před erozí pomocí využití kompostů z BRO
•Problematiku ochrany půdy řeší dva rezorty –MŽP (zákon o ochraně ZPF, zákon o odpadech),plošný dopad, vyšší právní síla…chybí prováděcí předpisy-“protierozní vyhláška“ -MZe zákon o rostlinné výrobě-SAPS, GAEC……parciální dopad-nižší právní síla….. •Řada dohod mezi MZe a MŽP za posledních 10 let (v rámci OP -podpora výstavby zařízení na zpracování BRO, národní dotační tituly, GAEC a pod) – výsledek ???? •Potřeba kompostů v zemědělství je o 100% vyšší než stávající produkce. Nelze zemědělcům uložit povinnost používat komposty. •Ekonomicky vyhodnotit navrhovaná opatření pro snížení eroze a zlepšení půdní retence v rámci České republiky- včetně plošného zabezpečení produkce organických hnojiv- kompostů.
Úkoly do budoucna pro MZe: -Ekonomicky vyhodnotit navrhovaná opatření pro snížení eroze a zlepšení půdní retence v rámci České republiky. - Na základě stávajících erozních map a map půd se sníženou retenční schopností určit pro jednotlivé regiony v České republice množství a druh organické hmoty, které bude potřebné pro zlepšení sledovaných vlastností půd. - Vyhodnotit a kvantifikovat vliv zapravení organické hmoty do půdy na snížení ztráty půdy vodní erozí. - Vyhodnotit a kvantifikovat vliv zapravení organické hmoty do půdy na retenční a infiltrační schopnost půdy.

GAEC Standardy dobrého zemědělského a environmentálního stavu platné od roku 2010 GAEC č.1 – Žadatel na půdním bloku, popřípadě jeho dílu s druhem zemědělské kultury orná půda, jehož průměrná sklonitost přesahuje 7° zajistí po sklizni plodiny založení porostu následné plodiny, nebo uplatní alespoň jedno z níže uvedených opatření: -strniště sklizené plodiny je ponecháno na půdním bloku, popřípadě jeho dílu minimálně do 30.listopadu, nebo půda zůstane zorána, popřípadě podmítnuta za účelem zasakování vody minimálně do 30.listopadu. Komentář- ponechání strniště sklizené plodiny na půdním bloku, jehož průměrná sklonitost přesahuje 7° minimálně do 15. února kalendářního roku v němž má být podpora poskytnuta je méně vhodné po sklizni zrnin, kdy je zpravidla povrch půdy utužený, který napomáhá rychlému odtoku vody a vede k nedostatečnému zasakování vodních srážek do spodních vrstev půdy, Komentář ustanovení č. 2 lze akceptovat v plném rozsahu podmítka i orba napomáhají zasakování do půdy a přispívají ke zvyšování retence vody v krajině U GAEC 1 je navrhováno zaměření standardu na opatření vůči větrné erozi a tato možná změna by mohla být předmětem dalších jednání.

GAEC Standardy dobrého zemědělského a environmentálního stavu platné od roku 2010 GAEC č.2- Žadatel na ploše půdního bloku, popř. jeho dílu, označené v evidenci půdy jako silně erozně ohrožená, zajistí, že se nebudou pěstovat širokořádkové plodiny kukuřice, brambory, řepa, bob setý, sója a slunečnice. Komentář: V současném LPIS jsou již dnes vedeny pozemky se svahovitostí nad 7° s oznámením uživatelům produkčních půdních bloků, že je zakázáno setí a sázení rizikových kultur. -Porosty obilnin a řepky olejné na těchto plochách budou zakládány s využitím půdoochranných technologií, zejména setí do mulče, nebo bezorebné setí.V případě obilnin nemusí být dodržena podmínka půdoochranných technologií při zakládání porostů pouze v případě, že budou pěstovány s podsevem jetelovin. Komentář: V současné době již tyto technologie existují a uvedené způsoby bývají praktikovány -Od roku 2011 na půdních blocích vedených v kategorii půd mírně erozně ohrožených je nutno zakládat porosty kukuřice, brambor, řepy, bobu setého, sóji a slunečnice pouze s využitím půdoochranných technologií, zejména setí a sázení do mulče, nebo bezorebné setí. Komentář: Dodržování těchto podmínek v případě sázení brambor je velmi problémové, neboť jejich velkoplošné produkční pěstování ve specializovaných zemědělských podnicích je založeno na technologii odkameňování.GAEC 2 by se mohly zpřísnit podmínky v návaznosti na povodně 2013 a to alespoň částečným zreálněním ploch silně erozně ohrožených (SEO) a mírně erozně ohrožených (MEO) z 11% alespoň na 36%.
Ochrana
GAEC Standardy dobrého zemědělského a environmentálního stavu platné od roku 2010 GAEC č.3- Žadatel o dotace (SAPS) na minimálně 20% jím užívané výměry s druhem zemědělské kultury orná půda, vztažené k celkové výměře tohoto druhu kultury užívané k 31.5. příslušného kalendářního roku v evidenci půdy, zajistí každoročně: a) aplikování tuhých statkových hnojiv, nebo tuhých organických hnojiv v min.dávce 25 tun na hektar, s výjimkou tuhých statkových hnojiv z chovu drůbeže, kde je minimální dávka stanovena na 4 tuny na ha. Při plnění podmínky zapravením ponechaných produktů při pěstování rostlin (např. slámy) podle jiného právního předpisu není stanovena minimální dávka nebo b) pokrytí tohoto % výměry, popřípadě jeho odpovídající části, v termínu minimálně od 31. 5. do 31. 7. příslušného kalendářního roku porostem jedné z následujících plodin, popřípadě jejich směsí: jeteloviny, vikev huňatá, vikev panonská, vikev setá, bob polní, lupina modrá, hrách setý. Účel - Zachovat úroveň organických složek půdy, zajistit návratnosti živin do půdy a tím zvyšovat půdní úrodnost a příznivě ovlivňovat vodní režim půdy. Řešení.Využívání organických hnojiv,které zajistí nejkvalitnější OL !!!! Předmětem k diskuzi vypuštění podmínky zapravení slámy jako posklizňového zbytku a stanovení střídání hnojených ploch.
Závěr: Je třeba vytvořit funkční systém, který by spočíval v tlaku na zvýšení poplatků za skládkování BRO (zákon o odpadech), vylepšení ekonomiky kompostáren , podmínka, aby komposty z BRO končily na zemědělské půdě a zvýhodnění zemědělců využívajících komposty. Dotace pro zemědělce na používání kompostů nejsou reálné vzhledem k zisku který toto odvětví dlouhodobě vytváří: /Rok 2013 odhad 14 mld. Kč.;rok 2012 16 mld.Kč.,rok 2011 17 mld. Kč., rok 2010 7,7 mld., Kč. Vytvořit motivaci k hnojení kompostem. -SNÍŽENÍ CEN KOMPOSTŮ (V SOUČASNOSTI 500-1000 Kč/t.) -NAROVNÁNÍ VLASTNICKÝCH VZTAHŮ K PŮDĚ- (80% ZEMĚDĚLSKÉ PŮDY JE PRONAJATO ); -ZPŘÍSNĚNÍ POVINNOST V RÁMCI GAEC, ZEJMÉNA V EROZNĚ OHROŽENÝCH OBLASTECH; -ZVÝŠENÁ OSVĚTA A ZLEPŠENÍ MARKETINKU ORGANICKÝCH HNOJIV; -ZAPOJENÍ ZEMĚDĚLCŮ DO SYSTÉMU KOMPOSTOVÁNÍ BRO.
